By accessing or using Snap Gather Grow ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Snap Gather Grow is a platform that connects physical keepsakes to collaborative digital photo and video feeds via QR codes. The Service allows users to create events, upload media, and share memories with others.

User Accounts

Account Creation

To use certain features of the Service, you must create an account using Google OAuth. You are responsible for maintaining the security of your account and all activities that occur under your account.

Account Termination

You may delete your account at any time through your profile settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in harmful behavior.

User Content

Your Responsibilities

You are solely responsible for the content you upload to the Service. You represent and warrant that:

• You own or have the necessary rights to all content you upload
• Your content does not violate any third-party rights
• Your content does not contain malicious code or viruses
• Your content complies with all applicable laws and regulations

Prohibited Content

You may not upload content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains nudity, pornography, or sexually explicit material
• Promotes violence, discrimination, or hatred
• Infringes on intellectual property rights
• Contains spam, advertising, or commercial solicitation

Content License

By uploading content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service to you and other event participants.

Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable. You may delete your own content at any time.

Subscription and Payments

Free Plan

We offer a free plan that allows you to create up to 3 events. The free plan includes all core features with some limitations.

Pro Plan

Our Pro plan provides unlimited events and additional features. Pro subscriptions are billed monthly or annually through Stripe. You may cancel your subscription at any time.

Refunds

Refunds are handled on a case-by-case basis. Contact us at hello@snapgathergrow.com to request a refund.

Intellectual Property

The Service and its original content (excluding user-uploaded content), features, and functionality are owned by Snap Gather Grow and are protected by international copyright, trademark, and other intellectual property laws.

Third-Party Services

We use third-party services including Google Cloud Platform, Mux, and Stripe. Your use of these services is subject to their respective terms of service and privacy policies.

Limitation of Liability

To the maximum extent permitted by law, Snap Gather Grow shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data, though we make reasonable efforts to protect and back up your content.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless Snap Gather Grow from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
